Equal Allowance System over District-owned Agricultural Land --- Section   1   :   Preamble
  Every citizen resident in the District has equal rights over rent that comes from the land owned by the District. This Act is to create administrative procedures, using which, citizens can directly obtain the rent over district-owned land.

Section   2   : Scope and format of the act
2.1 This act applies ONLY on the plots owned by district govt, and NOT on the plots owned by the private parties in the district. The act does NOT also apply on plots in the district that are owned by Central and State Govt bodies.
2.2 The act may apply on the plots owned by Central and State Govt bodies, AFTER State/Central Govts hand over the land they do not need to the district.
2.3 If the district govt buys the plots from private parties, this act will apply on those plots as well.
2.4 Many of the clauses of this law are procedures or instructions, which may be an order or a request. The clause has list of persons for whom that procedure/instruction is meant for.

Section   3   : Appointing senior officers and plotting of district-owned land
3.1 [Person responsible for this procedure : Sarpach] Within 15 days after passing of this law, the Sarpach will appoint 1 Registrar, 1 Land Plotting Officer and 1 Anti Encroachment Officer for the district.

3.2 [Person responsible for this procedure : Land Plotting Officer] Within 30 days after appointment, the Land Plotting Officer will publish the plot boundaries for the lands in the District, and for each plot, he will decide the length of lease and conditions of use.


Section   4   : Procedures to allocate land allowances
4.1 [Person responsible for this procedure/directive: Registrar ; ] The Registrar will issue a serial number to any person or company which seeks to use the district-owned plots.
4.2 [Person responsible for this procedure/directive: Registrar, Registrar’s Clerks ; Purpose: Allocation of citizen’s land allowance] (i) When the citizen gives his ID and serial number of the person/company who seeks to use the district-owned plots, the clerk will allocate Land Allowance of that citizen to that plot seeker. (ii)The clerk will provide a receipt to the citizen which will have citizen’s ID card number, land seeker's number, date and a serial number. (iii)The citizen can change the land seeker any day.
4.3 [Person responsible for this procedure/directive: Registrar, Clerks; Purpose: Funding of Allocation] The clerk can charge a fee of upto Rs 5 from the citizen per allocation
4.4 [Person responsible for this procedure/directive: Registrar] Every month the Registrar will issue the list of land users and list of citizens who have given allowances to them.

Section   5   : Procedures to allocate land
5.1 [Person responsible for this procedure/directive: Registrar] On 5th of every month, the Registrar will issue Allowance to land seekers, equal to number of Allowances citizen-residents have given to land-seekers.
5.2 [Person responsible for this procedure/directive: Registrar] On 5th of every month, the Registrar will reduce the Allowances plot seekers had obtained over 6 six months ago by 10%.
5.3 [Person responsible for this procedure/directive: Registrar : Purpose : actual allocation of plots] on 1st of every month, the Registrar will publish the list of plots on which have NOT been allocated or the lease is to expire within next 6 months. The Registrar will hold the auction for plots on 15th of that month. The land seeker with highest number of allowances will decide the plot that will be auctioned. The bids will be in terms of the Allowances.
5.4 [Person responsible for this procedure/directive: Registrar : Purpose : actual allocation of plots] If the plot is already occupied by a party, the existing holder will need to bid only 50% of the Allowances that the highest bidder has bidded, to beat his bid.
5.5 [Person responsible for this procedure/directive: Anti Encroachment Officer] The existing plot holder, if he loses the auction, will have to evacuate the plot at the end of the lease. If he does not, the Anti-encroachment officer will evacuate the land for him.

Section   6   : Procedures to replace Anti Encroachment Officer, Registrar, Plotting Officer and Mining Company
6.1 [Person responsible for this procedure : Registrar] Any citizen of India who wants citizens’ Approval for the position of Anti Encroachment Officer in the District can register himself with the Registrar. The Registrar will charge a registration fee of Rs 1000 and a monthly fee Rs 100 per month. There will be no fee after over 5% of ALL citizens have approved the candidate.
6.2 [Person responsible for this procedure : Registrar, Registrar’s clerks] A citizen residing the district can present his ID and specify the serial numbers of (at most 5) candidates he Approves for the position of Anti Encroachment Officer. The clerk will enter the requests in the systems and give the receipt to the citizen. The citizen may change his choices any day any month.
6.3 [Person responsible for this procedure : Registrar] The clerk may charge a fee of upto Rs 5 from the citizen.
6.4 [Person responsible for this procedure : Registrar] The citizen can withdraw his Approvals any day. There will be no fee from withdrawing the Approvals.
6.5 [Person responsible for this procedure : Sarpach of Land and Lands] If any candidate is approved by highest number of citizen-voters and over 25% of ALL citizen-voters in the district, the Sarpach will appoint him as new Anti Encroachment Officer within 2 days. If any candidate is approved by over 25% of ALL citizen-voters and his approval is 1% more than existing Anti Encroachment Officer, the Sarpach will appoint him as new Anti Encroachment Officer within 2 days. The Sarpach cannot remove a Land Officer, previously approved by citizens, unless Approval goes below 20% of ALL citizens.
6.6 [Person responsible for this procedure/directive: Registrar ; Purpose:] Word "citizen" in the context of Approval, means citizen above 18 and registered voter resident in the district
6.7 [Person responsible for this procedure/directive: Registrar, Sarpach ; Purpose: Replacement of Land Plotting Officer] The Registrar and Sarpach will also use procedures listed in 6.1 - 6.5 to enable citizens to replace Land Plotting Officer.
6.8 [Person responsible for this procedure/directive: Registrar, Sarpach ; Purpose: Replacement of Land Plotting Officer] The Registrar and Sarpach will also use procedures listed in 6.1 - 6.5 to enable citizens to replace Registrar.
6.9 [Person responsible for this procedure/directive: Registrar, Sarpach ; Purpose: Replacement of Land Plotting Officer] The Registrar and Sarpach will also use procedures listed in 6.1 - 6.5 to enable citizens to replace the mining company on any of the plots.

Section   7   : Company wholly owned by allowance givers
7.1 [Person responsible for this procedure/directive: Registrar] The Registrar will allow a company seeking agricultural land to register itself as "company WHOLLY owned by Allowance givers". The company must have 1 Chairman and 5 Directors, who will have powers to hore/expel any employee.
7.2 [Person responsible for this procedure/directive: Registrar] In such a company, the Registrar will issue shares ONLY to those who have given the Allowances to the company, and it will be equal to the number of Allowances they have given to that company. The allowance giver will get the share 1 year after he gives the allowance.
7.3 [Person responsible for this procedure/directive: Directors] The Directors with majority voting may decide a fee that allowance giver to pay a fee before he may give his allowance to that company. If such a fee has been set, the Chairman MUST collect the fee from the allowance giver at the time of giving allowance. The company's shareholders or directors will have right to refuse the entry of an allowance giver without giving any reasons within 1 year. In the shareholders/directors deny the entry, the Chairman will refund the fee minus 10% overheads.
7.4 [Person responsible for this procedure : Registrar ; Purpose - RLPP over Chairman] The Registar will allow the shareholders to replace Chairman using a procedure as described in clauses 6.1 to 6.5. The Registar will allow any citizen of India to become a candidate for Chairman. The shareholder can approve upto 5 candidates, and he may cancel his approval any day. If any candidate's approval exceeds 25% of ALL shareholders and it is 2% higher than the approval of existing Chairman, the Registrar will expel the Chairman, and appoint the candidate with highest approval as new Chairman.
7.5 [Person responsible for this procedure : Registrar ; Purpose - RLPP over Directors] The Registar will allow any citizen of India to become a candidate for Director. The shareholder can approve upto 10 candidates, and he may cancel his approval any day. If any candidate's approval exceeds 25% of ALL shareholders and it is 2% higher than the approval of Director with lowest approval, the Registrar will expel the Director with lowest approval, and appoint the candidate with highest approval as new Director.

Section   8   : Other Details
8.1 The rupee amount used in this text uses July-2000 price levels. The officers in-charge can adjust the amounts every six months using RBI’s Inflation Index.
8.2 If the officer does not execute a procedure or ignores an instruction stated in this Resolution/Act, a citizen can file a complaint before the Grand Jurors of the Districts in which the zone falls. Under this law, a citizen cannot complaint before the Sarpach, officer or judges.
8.3 The Jurors will judge this Act, guidelines, intentions as well as the facts related to the case
