PROSEC.01   ---   Disclosure   rules   for   Govt   Officials





  DRAFT-1 Disclosure rules for assets of Employees of District Panchayat (citizens need to pass this draft District Panchayat)


Section   1   : Disclosure of Assets by the employees of District Panchayat
3.1 [Person responsible for this procedure/directive: Sarpanch ; ] The Sarpanch will request every employee of District Panchayat, including employees of Gram and Tahsil Panchayat, including members and Sarpanch of Gram, Tahsil and District Panchayats, to disclose following of his assets as on Mar-31 of every year :
  1. His Income tax ID
  2. His income tax and wealth tax retruns of past 6 years
  3. His current cash assets, and sum of bank balances
  4. Deposits he has with banks, other companies and loans he has given
  5. Gold, silver etc he owns
  6. Book/market value of land and houses he owns
  7. Value of shares he owns
  8. List of trusts he is trustee in ; income tax returns and balance sheets of ALL those trusts of past 5 years
  9. List of companies in which he is partner or director, or has been partner or director and his %-ownership in those companies, and income tax returns, balance sheets of all those companies of past 5 years.
An empoloyee will need to submit these disclosures for upto 5 years after he is expelled from the position or he retires or he voluntarily resigns.
3.2 [Instruction to Grand Jurors] The Grand Jurors, after going through the report submitted by 3 economists nominated by Sarpanch, will decide two numbers : 1)median income of citizen resident in the District and 2)median wealth owned by the citizen resident in the District.
3.3 [Instruction to Mayor] If the income of the employee plus incomes of the trusts/companies he is trustee/director/partner in, is above N times the median income, or if the wealth employee owns plus wealth the trusts/companies he is trustee/partner/director of, is above N times the median wealth owned, the Sarpanch will ask the employee to put the disclosure as desribed in section 3.1 to put on web-site of District's Govt. The number "N", will be decided by the Grand Jurors.
3.4 [Instruction to citizens, Grand Jurors] If a citizen residing in India has evidences to show that an employee has given wrong information in the disclosure, he may present evidences before the Grand Jurors. If over 15 Grand Jurors agree that evidences require detailed examination, the Jury Administrator will summon a Jury of 12 citizens to examine the evidences.
3.5 [Instruction to Sarpanch] If over 8 out of 12 Jurors declare that the accused officer is NOT fit to serve the citizens, the Sarpanch will resign, or ensure that officer is expelled for good.

[I will later publish Draft PROSEC.01-02, which will enable citizens to obtain income/asset disclosure from ALL employees of State Govt employees including CM, Ministers, MLAs and Lower Court judges, and enable Jurors to expel these employees if the Jurors conclude that disclosures are wrong.
